(a) If any person shall own, keep or use any yard, pen or place on his or her premises in this City under his or her control in or upon which any number of cattle, horses, sheep, goats, dogs, cats or other animals shall be kept in such a manner as to be or become offensive to those residing in the vicinity or annoying to the public, he shall be deemed to maintain a nuisance in the city and upon conviction shall be fined not less than $50.00 nor more than $500.00, plus court costs, for the first offense, and like sum each day thereafter the same shall continue. After 3 offenses, persons are subject to not being allowed to have animals.
(b) Subject to subsection (a), the following animals are allowed in limited numbers per household as follows:
(1) Chickens – no more than 12 hens and 1 rooster
(2) Horses/cattle – no more than 1 per open acre
(3) Goats – no more than 2 per open ¼ acre (limit of 4)
(4) Sheep – no more than 2 per open ½ acre (limit of 2)

Any person who, in this city, shall keep any ground, yard, stockyard, or any house, shop, stable or any other place in this city, in such a condition as to be offensive and a nuisance, shall be guilty of maintaining a nuisance and upon conviction shall be fined in any sum not less than FIFTY DOLLARS ($50.00) for the first offense, and a like sum each day thereafter the same shall continue, plus any cleanup fees.

It shall be unlawful for any person to dump, throw, place, deposit or leave, or cause to be dumped, thrown, placed, deposited or left in, on, or about any city street, highway, alley, right-of-way, park or other public place, lake, stream, watercourse or other body of water, or any private property, any dirt, filth, sewage, sweeping, dump ashes, tin cans, bottles, glass, paper, rags, tree cuttings, garbage, or other refuse of any kind, except by direction of the mayor or enforcing officer or employee authorized by law to direct or permit such acts where public property is involved, or with the consent of the owner or occupant where private property is involved. Any person violating any provisions of this section shall, upon conviction thereof, be fined in any sum not less than ONE HUNDRED DOLLARS ($100.00), plus any cleanup fees.

In case said owners, his heirs or their agents or attorneys, shall, after service as aforesaid made, fail, neglect, or refuse to comply with the directions of such resolution within the time specified, then said nuisances or any of them shall be removed and abated at the expense of the city, and the amount of money so expended shall be a debt due to said city from the owner or owners of said lot or lots or pieces of ground in proportion to the amount or amounts expended thereon respectively, and said debt, or any portion of it, made according to the provisions of this article, shall, from the time of the adoption of the resolution hereinbefore provided, become a lien upon said lot, lots or pieces of ground, and shall be deemed a special assessment on and against the same, and shall be certified to the county clerk of Wilson County, to be by him placed on the tax roll, subject to the same penalties, and collected; or collected by any other legal means.
