CHAPTER 14. TRAFFICCHAPTER 14. TRAFFIC\Article 4. Truck Routes

It shall be unlawful for any person, firm, partnership, association, corporation, company or organization of any kind to operate a truck, tractor or vehicle, including trailers attached thereto, having a registered gross weight of in excess of 20,000 pounds on any street located within the City of Buffalo, Kansas, other than along the following designated truck routes:

(a)   Main Street

(b)   Microlite Street

(c)   Fife Street

All trucks or other vehicles as defined in Section 14-401 shall be operated in the city only over and along the truck routes established and set forth herein, however, this article shall not prohibit:

(a)   The operation of a truck upon any street where necessary to make a commercial delivery of goods or pick up materials or merchandise, provided that such truck be operated in the shortest and the most direct route to the destination from a truck route in order to make the local delivery or pick up and then return to a truck route by the shortest and most direct route;

(b)   The operation of emergency vehicles upon any street in the city;

(c)   The operation of trucks owned or operated by the city, public utilities and contractors while engaged in repair, maintenance or construction;

(d)   The operation of a truck which originates within at a point not on a truck route as a means of traveling to the nearest truck route; the city

(e)   The operation of a truck which is regularly used by a place of business within the city or garaged in the city and the destination of which is within the city following the route which uses the least number of non-truck route blocks from point of origin to point of destination and back;

(f)    A truck garaged outside the city, but with an access road only through the city traveling to and on the nearest truck route;

(g)   Recreational vehicles and church and school buses regularly housed within the city.

No person shall stop, stand or park a truck, as defined in this article, upon a street or public right-of-way within the city. Tractors will be allowed on private property, but trailer parking is not allowed.

All truck routes shall be clearly signed to give notice thereof.

Violation of this article will result in the truck being towed at the owner/operator’s expense. Violation of this article is a misdemeanor. Upon the first conviction of a violation of this article, a person or entity as set forth herein shall be fined not less than $100.00 plus court costs and any applicable road damage repair expenses or damage to public property. Upon a second conviction within twelve (12) calendar months, such person or entity shall be fined not less than $250.00 plus court costs and any applicable road damage repair expenses. Upon a third (3rd) or subsequent conviction within twelve (12) calendar months, such person or entity shall be fined not less than $600.00, plus court costs and any applicable road damage repair expenses.
